Sample letter for Slip/Buoy Agreement

Many of our members and non-members have contacted me after receiving the “new 2007 Agreement”.

This Agreement is NOT endorsed by the Club.

The Board of Directors of the Lake Powell Yacht Club

is opposed to the new Agreement!

What follows is a sample letter you may feel free to use in response to your receipt of the Version 9/06 Agreement.

Dear Ms. Schebesta:

We are in receipt of your recent request that we execute Moorage and Dockage Agreement Version 9/06. We are unable to sign this document for the following reasons:

    1.    It would require us to comply with an NPS legal opinion that NPS refuses to provide (Paragraph 1 of the Agreement.)

    2.    It would require us to acknowledge "facts" that are or may become untrue (Paragraphs 7A, 9A and 11.)

    3.    It would require us to provide documentation that is or may become unobtainable (Paragraphs 4, 5 and 16.)

These problems and others were identified to your Vice President, Mr. Gib Johnson, in a meeting with Lake Powell Yacht Club representatives and Ms. Kitty Roberts in Ms. Roberts' NPS office on February 12, 2007.
